Welcome to Ellim. These Terms of Use (“Terms”) govern your access to and use of the Ellim fitness application and related services operated by Greg Polak (“Ellim,” “we,” “us,” or “our”). By downloading, installing, or otherwise using Ellim, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the Service.
By accessing or using the Service, you acknowledge you are at least 18 years old (or of legal age in your jurisdiction) and have the capacity to form a binding contract. You agree to these Terms and our Privacy Policy, incorporated herein by reference. We may modify these Terms at any time; material changes will be communicated (e.g., in-app notification or email). Continued use after the effective date of changes constitutes your acceptance.
Ellim is designed to help you track workouts, log nutrition and meals, record health and fitness metrics (including calorie estimates, macronutrient data, and physical profile data such as weight and height), set fitness goals, and view progress over time.
Core features include workout logging, nutrition tracking, AI-powered meal detection, AI routine generation, progress charts, goal setting, reminders, cloud-based data backup and sync, and optional integrations (e.g., Apple Health, Google Fit). We may add, remove, or modify features at any time.
Account Creation. To access certain features, you must create an account with a valid email and secure password. Provide accurate information and keep credentials confidential.
Account Security. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
Eligibility. You affirm you are at least 18 years old and will not impersonate any person or entity.
Suspension/Termination. We may suspend or terminate accounts for violations of these Terms, harmful conduct, legal compliance needs, or security reasons. Where appropriate, we will provide notice.
Limited License. Subject to your compliance, we grant you a revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes on devices you own.
Restrictions. You agree not to:
Reverse engineer or decompile the Service
Modify, distribute, rent, lease, or sublicense the Service
Remove proprietary notices
Use the Service unlawfully or to store malicious code
Scrape or harvest data in an unauthorized manner
Circumvent usage limits or security features
Definition & Ownership. “User Content” means any data, information, text, images, or other materials you upload, post, submit, or otherwise make available through the Service, including workout logs, calorie estimates, nutrition and meal data, food photos, body measurements, physical profile data (such as weight and height), profile details, and photos. You retain ownership of all User Content you create or upload.
License to Ellim. You grant Ellim a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display your User Content solely as necessary to operate, maintain, improve, and provide the Service to you, comply with law, and enforce these Terms. We will not use your identifiable User Content for marketing or promotional purposes without your separate consent.
Aggregated/Anonymized Data. We may aggregate or anonymize User Content so that it no longer identifies you, and freely use such data for analytics, research, and product improvement.
Deletion of Content. You may delete or edit individual pieces of User Content at any time via the app. Deleted content is removed from live systems; backups may persist for up to 30 days for legal or technical reasons.
Data Access. The Service does not currently provide an in-app bulk export tool. However, you may contact us at privacy@ellim.app to request access to your data as described in our Privacy Policy.
Third-Party Integrations. If you connect to third-party services (e.g., Apple Health), you authorize us to access and use the necessary User Content as described in our Privacy Policy. Their use of your data is governed by their own policies.
Your Representations. You represent that you own or have the necessary rights to all User Content and that it does not violate any law or third-party rights.
No Confidentiality. Unless expressly agreed otherwise, do not submit confidential information as User Content.
The Service is provided for informational and fitness-tracking purposes only and is not a medical device, nutritional counseling tool, or dietary planning service. It is not a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before beginning any exercise program and consult a qualified nutritionist or dietitian before making dietary changes. Use the Service at your own risk.
AI-Powered Features:
AI-generated routines, nutritional estimates, recommendations, and other outputs may be inaccurate, incomplete, or unsuitable for your specific health condition, fitness level, or goals.
Nutritional values provided by AI features are estimates only and should not be relied upon for medical dietary requirements, allergy management, or any condition requiring precise nutritional tracking.
The Service does not detect allergens, restricted foods, or dietary contraindications. If you have food allergies, intolerances, or medical dietary restrictions, you must independently verify all food content.
What you eat and how you exercise is your responsibility. Ellim is not liable for any health consequences arising from decisions made based on information provided by the Service.
You should always use independent judgment and consult a qualified professional where appropriate.
All elements of the Service (excluding User Content) are owned or licensed by Ellim and protected by intellectual property laws. “Ellim” and associated logos are trademarks of Ellim.
You agree not to engage in illegal, fraudulent, abusive, infringing, or harmful conduct, including attempts to interfere with the Service or access data without authorization.
Free Features. Certain features of the Service are available at no cost. Some features may require account registration. We reserve the right to change which features are free and which require a paid subscription at any time.
Premium Subscription. Premium features, including AI-powered features, are available through auto-renewable subscriptions. Pricing, billing periods, and any free-trial offers are displayed in the app or App Store at the time of purchase. Certain features may be subject to usage limits (such as daily or monthly caps), which may vary by subscription plan.
Free Trial. New subscribers may be eligible for a free trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.
Auto-Renewal. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation. You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except where required by applicable law.
Price Changes. We may change subscription prices from time to time. You will be notified in advance of any price increase.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELLIM SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.
Liability Cap. Ellim’s total liability shall not exceed the amount you paid in the six (6) months preceding the claim or USD $100, whichever is less.
You agree to indemnify and hold harmless Ellim from claims arising from your use of the Service, User Content, or violation of these Terms.
You may terminate these Terms by uninstalling the app and ceasing use. Uninstalling the app does not cancel subscriptions; you must cancel through the purchase platform.
We may suspend or terminate access for violations or if the Service is discontinued.
These Terms are governed by the laws of the State of Israel. Disputes shall be resolved exclusively in the courts of Tel Aviv-Yafo, Israel.
We may modify, suspend, or discontinue any aspect of the Service at any time without liability.
