Terms of Use
Welcome to Ellim (“Ellim,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Ellim exercise-tracking application and any associated websites, features, or services (collectively, the “Service”). By downloading, installing, or otherwise using Ellim, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the Service.
By accessing or using the Service, you acknowledge you are at least 18 years old (or of legal age in your jurisdiction) and have the capacity to form a binding contract. You agree to these Terms and our Privacy Policy, incorporated herein by reference. We may modify these Terms at any time; material changes will be communicated (e.g., in-app notification or email). Continued use after the effective date of changes constitutes your acceptance.
Ellim is designed to help you track workouts, record health and fitness metrics (including calorie estimates and physical profile data such as weight and height), set fitness goals, and view progress over time.
Core features include workout logging, progress charts, goal setting, reminders, cloud-based data backup and sync, and optional integrations (e.g., Apple Health, Google Fit). We may add, remove, or modify features at any time.
Account Creation. To access certain features, you must create an account with a valid email and secure password. Provide accurate information and keep credentials confidential.
Account Security. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
Eligibility. You affirm you are at least 18 years old and will not impersonate any person or entity.
Suspension/Termination. We may suspend or terminate your account for violations of these Terms or harmful conduct, with or without notice.
Limited License. Subject to your compliance, we grant you a revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes on devices you own.
Restrictions. You agree not to:
Reverse engineer or decompile the Service
Modify, distribute, rent, lease, or sublicense the Service
Remove proprietary notices
Use the Service unlawfully or to store malicious code
Scrape or harvest data in an unauthorized manner
Circumvent usage limits or security features
Definition & Ownership. “User Content” means any data, information, text, images, or other materials you upload, post, submit, or otherwise make available through the Service, including workout logs, calorie estimates, body measurements, physical profile data (such as weight and height), profile details, and photos. You remain the sole owner of all User Content you create or upload.
No Data Export (for Now). The Service currently does not offer a bulk-export or download feature. You may view, edit, or delete individual entries, but cannot export your entire dataset in bulk. We will update these Terms if we introduce an export tool.
License to Ellim. To operate and improve the Service, you grant Ellim a perpetual, worldwide, royalty-free, transferable, sublicensable, and irrevocable license to use, reproduce, distribute, modify, prepare derivative works of, publicly display, and otherwise exploit your User Content for any lawful purpose, including:
Operating and enhancing the Service (e.g., generating charts, calculating calorie burn, syncing data across devices)
Research, analytics, and aggregate reporting (including anonymized trends)
Marketing and promotional uses (e.g., showcasing success stories)
Any other lawful purpose we deem appropriate
Deletion of Content. You may delete or edit individual pieces of User Content at any time via the app. Deleted content is removed from live systems; backups may persist for up to 30 days for legal or technical reasons.
Aggregated/Anonymized Data. We may aggregate or anonymize User Content and freely use such data for analytics, research, and product improvement.
Third-Party Integrations. If you connect to third-party services (e.g., Apple Health), you authorize us to access and use the necessary User Content as described in our Privacy Policy. Their use of your data is governed by their own policies.
Your Representations. You represent that you own or have the necessary rights to all User Content and that it does not violate any law or third-party rights.
No Confidentiality. Unless expressly agreed otherwise, do not submit confidential information as User Content.
The Service is provided for informational and fitness-tracking purposes only and is not a medical device nor a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before beginning any exercise or nutrition program. Use the Service at your own risk.
All elements of the Service (excluding User Content) are owned or licensed by Ellim and protected by intellectual property laws. “Ellim” and associated logos are trademarks of Ellim.
You agree not to engage in illegal, fraudulent, abusive, infringing, or harmful conduct, including attempts to interfere with the Service or access data without authorization.
Basic features are free. Premium features may require a subscription or one-time purchase. Subscriptions auto-renew unless canceled through the platform of purchase (e.g., Apple App Store, Google Play). Fees are non-refundable except where required by law.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELLIM SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.
Liability Cap. Ellim’s total liability shall not exceed the amount you paid in the six (6) months preceding the claim or USD $100, whichever is less.
You agree to indemnify and hold harmless Ellim from claims arising from your use of the Service, User Content, or violation of these Terms.
You may terminate these Terms by uninstalling the app and ceasing use. Uninstalling the app does not cancel subscriptions; you must cancel through the purchase platform.
We may suspend or terminate access for violations or if the Service is discontinued.
These Terms are governed by the laws of the State of Israel. Disputes shall be resolved exclusively in the courts of Tel Aviv-Yafo, Israel.
We may modify, suspend, or discontinue any aspect of the Service at any time without liability.
